Trout-Mud Creek Drain Information

*UPDATE November 19, 2015 - At the Board of Determination Hearing that was held at the Porter Township Fire Department on November 17, 2015, the Board declined the petition for the proposed drain.

POSTED November 6, 2015 - The Drain Commissioner operates under the Drain Code (State law). The notice received by parcel owners and municipalities is worded and formatted the way it is because it must follow the noticing guidelines described under the Drain Code. Under the code, a petition was submitted by the Cass County Road Commission to look at a drainage problem in part of Porter Township. The Road Commission feels that there are drainage issues off of their right-of-way that they have no authority to address. The code stipulates that a Board of Determination Hearing is to be scheduled and all parcel owners in that watershed are to be noticed. It is not required that you attend or speak at the hearing but you have the right to if you wish. The Hearing Board will listen to an engineer, petitioner, county, township, MDOT, and any parcel owner who wishes to speak. The Hearing Board is charged by the code to determine and answer the validity of the petition. The Hearing Board either issues an “Order of Necessity” or decides that the petition is not valid and the whole process stops at that point. The hearing decision is not determined by a majority vote of those attending. The preliminary district/watershed empties into the St. Joseph River from the state line all the way north to and including Birch Lake. Many drainage issues exist in this watershed, but the main focus of this petition is to answer the flooding issues on the east side of Long Lake on Idlewild Street and Central Avenue. Updates will be posted on the County webpage and the Drain Commissioner webpage. If you have a webpage please share and post this update.
